Terms Conditions
Please read the following terms and conditions carefully as purchasing from our stores means that you will be bound by them. In certain instances these terms incorporate statements to be found in the Security & Privacy, Payment, Returns & Refunds as well as the Delivery sections of our site. In all circumstances you the customer are responsible for making sure all items will fit in your property before purchase, sizes are found in the product descriptions and specifications tabs.

1. Waiver
Every effort has, is and will be taken to ensure that the information displayed in our stores is correct and up to date. The information may, however, become incomplete, inaccurate or out of date due to suppliers changing descriptions and specifications and not updating ourselves. To the full extent permitted by law, but subject to the terms and conditions of sale referred to below, we are not responsible for any financial loss and can not be responsible or liable for compensation claims due to the accuracy of any information contained in our Store and on our Website.

2. Definitions
For the purposes of these Terms and Conditions the following definitions apply:
Sale. The receipt for sale by us and purchase of Goods by you.
Goods. The range of products which are available for purchase from our store in accordance with the terms.
Store/Stores. Our physical stores.
We/us. Style & Comfort Interiors Ltd (company registration no 05221040), registered address: 72b New Court Way, Ormskirk, L39 2YT, trading as Bed Factory Direct. Head Office Marl Road, Knowsley Industrial Estate, L33 7UH.

3. Limitation of liability
a: Bed Factory Direct shall not be liable for any damage or loss that may occur in the use of any of the information or advice given in our store except as to the extent that such liability cannot be excluded by law.
b: Bed Factory Direct is not responsible for the store’s accuracy when suppliers have changed product specifications, product packaging or other product information.
c: Bed Factory Direct will not be liable for any compensation to you for delay due to any events beyond the control of Bed Factory Direct or its suppliers, including, but not limited to, delays caused by suppliers (lack of stock, delayed dispatch), delays caused by third party couriers, delays caused by traffic, delays caused by mechanical breakdown, acts of god, civil commotion, industrial dispute, riots, flood, and legislation.
d: Bed Factory Direct can not be held responsible if you book a third party to build your items before receipt of your delivery.
e: Bed Factory Direct can not be held responsible if you book a third party to build your items and they damage them.
f: Bed Factory Direct can not be held responsible for any damages caused to your property by third party couriers.
g: Bed Factory Direct can not be held responsible if you the customer choose to dispose of any bed, mattress or product before receipt of your delivery.
h: Bed Factory Direct can not be held responsible for items not fitting in your property.

4. Data protection and privacy
Any details which you provide to us from which we can identify you are held and processed in accordance with our Privacy Policy https://support.bedfactorydirect.co.uk/494503-Privacy-Policy.

5. Pricing
All prices quoted are in British pounds (£) and include Value Added Tax (VAT). If the price goes up or down in between you placing and receiving your order, we will honor the original price paid at the time of the sale.

6. Ordering, stock availability and products
6.1: We aim to display only items that are in stock in our warehouse, available for immediate manufacture in our factory and/or are available for direct despatch from our suppliers. From time to time we may sell out of some lines, run low on materials needed to manufacture an item or our supplier might run out of stock for direct despatch in which case we will aim to advise you the same day we are notified of this. In the cases of an item being a direct despatch item from our supplier, we are sometimes not notified of an item being unavailable until the day of despatch which can sometimes be the day before delivery. In all cases, you will be given the opportunity to order an alternative or receive a full refund for the full price you paid. In all cases as per section (3) Bed Factory Direct are not liable for any forms of compensation due to this.
6.2: Your order confirmation receipt is only an acknowledgement of your order and payment. It is not an acceptance amounting to a contract. Products sold in our store are for use in a domestic setting. If you wish to purchase items for commercial use please contact Bed Factory Contracts on 0800 917 6518 to discuss your product needs. Bed Factory Direct can not be held responsible if you purchase domestic products for commercial use.
6.3: Please note that some of the products in our stores are flat packed, so some assembly will be required, all Bed Factory Direct divans come in at least one part and you are responsible for making sure they fit in your property.
6.4: You should be aware that:
a: all bed and mattress sizes given are UK standard sizes;
b: mattress sizes may vary slightly from their stated dimensions due to manufacturing tolerances;
c: mattress comfort/hardness grading is for guidance only and will vary depending on your build and personal preference.
d: When placing a mattress on a bedstead please note that there maybe a gap around the edges; this is to allow for rotation & bedding.
e: Unless clearly stated in store, headboards will not normally be included with a divan bed. If a headboard is required this will need to be purchased as a separate item on your order.
f: It is often the case with new mattresses that they will require a 'bedding in' period of 8 to 12 weeks to allow the fillings to settle and the mattress to gently expand to the correct size. Additionally, on occasion new mattresses may carry an odour for up to 30 days. This may be due to the fire retardant, a legal requirement, and the newness of materials. This odour will gradually dissipate with airing.
g - All roll up mattresses are vacuum packed. Due to this these mattresses can take 3 to 4 days to fully expand.
h - All Divan beds are supplied with castors only, pictures showing glides are for illustrations only. Glides and peg feet are an extra option. Peg feet can be requested in your order comments box and glides can be purchased as an extra option.
i - You, the customer, are responsible for checking all items will fit before ordering.
6.5: You, the customer, are responsible for:
a: checking all items will fit before ordering,
b: that the correct address is entered on the order as we can only change the delivery address after a sale on order that have been paid for in cash,
c: that additional services requested (such as assembly or disposal) are clearly noted on your order. These will be shown separately. If they are not included then these have not been purchased and will not be provided.

7. Ex-Display Items (Sold From Floor)
7.1: If you have purchased an ex-display item the price of these items reflects the fact that they are Sold As Seen and may have sustained wear and tear and they cannot be returned or refunded unless faulty.
7.2: Any defects on ex-display items will be visible in store. All ex-display items will be on your order in the following grades: “A” Perfect Condition, “B” Small Marks, “C” Signs Of Wear & Tear, and “D” Chips or Dents. It will not be possible to reject the goods or claim a refund or repair at our expense in respect of any of these defects.

8: Payment
8.1: Full payment is required before delivery unless Cash On Delivery has been agreed in store at the time of purchase.
8.2: If you have chosen to pay by Finance, payment will be collected by the third party finance company as agreed

9. Delivery
9.1: Delivery can only be made to the delivery address specified on the Order.
9.2: Delivery can be an all day call on your preferred delivery date unless advised otherwise by our despatch department. You are responsible for making sure someone is available to accept the delivery.
9.3: During the order process you can select a preferred delivery date. This is your preferred date of delivery, delivery dates and delivery times are given in good faith but are subject to change. Please note we will do everything to meet you preferred date but this is not a guaranteed delivery date for your order.
9.4: Delivery will be deemed to have taken place when the Goods have been delivered to the address set out in the Order. We do not have the ability to satisfy Ourselves that the person accepting delivery at the agreed address is authorised by you to accept the Goods.
9.5: If no one is available to take delivery at the address given by you, you may be subject to a charge for re-delivery of £15 to £30 depending on location. If you choose to then cancel your order after delivery we will refund less the original delivery charge.
9.6: If delivery can not be completed due to the Goods not fitting in your property, in these circumstances you may order a different product as a replacement for the Goods:
a: You must pay the difference between the price of the Goods and any replacement product which is of higher value;
b: You must pay a redelivery charge of £30 to £50 depending on your postcode location.
c: If you wish to cancel and receive a refund, we will refund less the delivery charge.
9.7: If We are not able to deliver the whole of the Order at one time due to operational reasons or shortage of stock, We will deliver the Order in installments. We will not charge you extra delivery costs for this.
9.8: The Goods will be your responsibility from the completion of delivery
9.9: You must be a suitable adult over 18 years of age to check and sign for the goods.
9.10: You are responsible for checking the delivery and signing for the goods as received in good condition or received as damaged (not doing this can affect the ordering of replacements or refunds if damaged). Goods will be considered as received in good condition unless signed for as damaged on delivery sheets.
9.11: Goods will be considered as accepted when you have signed for delivery.
9.12: Our drivers reserve the right to refuse to deliver to your room of choice if they are concerned of damaging the goods or your property.

10. Cancellation
10.1: This cancellation right does not apply in the Following cases: a: Any products made to your special specifications or clearly personalised. This includes bespoke items made to custom sizes and heights. It is Your responsibility to check bespoke sized items fit into Your property as mentioned in 3(h). These are not returnable or refundable unless damaged. b: In the case of mattresses, bedding and bed linen, if the packaging has been opened, for reasons of health and hygiene these items by their Nature cannot be returned unless faulty. Please note that we cannot accept a return or cancellation once a mattress has been slept on. c: In the case of mattresses and divan beds, If Assembly service forms part of your order and the hygiene seal is broken and mattress bag removed we will not be able to accept return unless the goods are faulty,
10.2: To cancel a Contract, please tell Us in writing by email to customerservice@bedfactorydirect.co.uk, or write to Us at Bed Factory Direct, Marl Road, Knowsley Industrial Estate, L33 7UH. You may wish to keep a copy of your cancellation notification for your own records.
10.3: You will be required to arrange the return of your order at your own cost using your own courier within 14 calendar days from the date of cancellation. You will receive a full refund of the price you paid for the Goods Only. We will process the refund due to you as soon as your returned order has been received by Us in good condition in original packaging.
10.4: In the case of Faulty goods We can only offer to collect them from the original delivery address that was on your order.
10.5: We refund you on the original method of payment.
10.6: If the Goods were delivered to you:
a: Please inform us in writing to customerservice@bedfactorydirect.co.uk if you wish to return the goods.
b: You have a legal obligation to keep the Goods in your possession and to take reasonable care of the Goods while they are in your possession.
10.7: Before the Goods are delivered, you have the following rights to cancel an Order for Goods (other than Goods that are a special made Order), including where you choose to cancel because We are affected by an Event Outside Our Control:
a: you may cancel any Order for Goods at any time before We despatch the Goods by contacting Us in writing via email to customerservice@bedfactorydirect.co.uk quoting your order number and address. We will confirm your cancellation in by return email. There is a %10 charge taken from the value of your order if cancelled outside of 24hrs after ordering as goods will have been made in our factory.
b: unfortunately, if you cancel an order and We have already despatched your Goods to you, We will not be able to cancel your Order until it is delivered. In this case, if you return the Goods to Us, you will have to pay the cost of returning the Goods back to Us.
c: If you wish to refuse delivery of your order please contact our office by phone 0800 860 6060 immediately for advice. Please be aware that we will refund your order once goods have been received back less a delivery charge of £29.99.
10.8: In regard to all sales where you wish to return the Goods, you must keep the Goods in good condition, including by not using them, and where possible retain the packaging which the Goods came in. Any flat-pack goods must be returned as such, without having been assembled (unless they are faulty or mis-described). In particular, duvets, mattresses and bedding must not have been used and must be in the original un-opened sealed packaging.

11. Our Rights To Cancel
Your order will be cancelled automatically if we are recommended to do so by our card processing company. If this occurs we will inform you by email. We will not be able to tell you why the have recommended this as we are not privileged to that information. Any monies set aside by your bank as pending will be returned to you by your bank. This can take up to 7 days and Bed Factory Direct will not have received this payment and can not control how long this will take with your bank.

12. If the goods are faulty
12.1: As a consumer, you have rights in relation to Goods that are faulty under the Consumer Rights Act.
12.2: To help us ascertain the nature of the fault we may ask you to provide evidence to us in the form of images as quickly as possible within 14 days of delivery, they can be either sent to Us using the form in our FAQ pages, emailed to customerservice@bedfactorydirect.co.uk or by post to our address. Failure to provide this evidence may prevent Us from progressing the issue.
12.3: An inspection might be needed. In this case we will contact you to let you know when this will be done.
12.4: If you report the fault within 14 days of delivery Under the Consumer Rights Act, you have an early right to reject goods that are of unsatisfactory quality or not as described, and get a full refund.
12.5: If you have rejected the delivery due to the goods being faulty or the packaging damaged, you are entitled to reject the goods at time of delivery and claim a full refund or replacement. Please let us know by email to customerservice@bedfactorydirect.co.uk and as soon as we have confirmed with the courier that you have rejected the delivery and it is being returned to us we will process the refund or replacement within 14 days.
12.5: In the case of a replacement being offered this will be of equivalent quality to the original product purchased from the manufacturer's current range up to the value of what you have already paid or greater if you pay the difference.
12.6: If you report the fault outside 30 days of delivery, we the retailer have an opportunity to repair or replace any faulty goods before offering a full refund.
12.7: If you report the fault after the first 6 months the burden is on you to prove the fault has been there since delivery.

13. Warranties
We aim to deliver goods of the highest quality. Unless otherwise stated in store, the products sold have a warranty of 12 months.
13.1: We guarantee that on delivery and for a period of 12 months from delivery, that goods shall be free from substantial defects.
13.2: Warranties do not apply to any defect in the goods arising from:
a: fair wear and tear,
b: wilful damage, abnormal storage or working conditions, accident, negligence by you or by any third party, soilage or stains,
c: if you fail to take care of or use the goods in accordance with user instructions,
d: if you fail to follow any assembly instructions correctly or damage the goods due to assembling with incorrect tools,
e: any alteration or repair carried out by yourself or any third party company not authorised by us
f: failure to rotate or turn the mattress in accordance with instructions or guidelines.

14. Changes to the terms
Bed Factory Direct reserves the right to remove, modify or change, without notice, any information in our Stores from time to time. Bed Factory Direct may change these terms at any time by posting notice of the changes in Store and on our website. If you purchase from our store Bed Factory Direct has posted the changes you will be bound by the new terms. You should therefore ensure that you read the terms each time you purchase.

15. General
E-mails to you will be sent to the address you specify to us. You must only provide us with a valid e-mail address and it is your responsibility to inform us of any changes to that address. To the extent that any provision of these terms is found by any court or authority to be invalid, unlawful or unenforceable, that provision will be deemed not to be a part of these terms and will not affect the enforceability of the remainder of these terms, nor will it affect the validity, lawfulness or enforceability of that provision in any other jurisdiction. The headings in these terms are for convenience only and do not affect their interpretation. These terms supercede any representation made by us or any of our employees or agents.

16. Compensation
If compensation is offered for any reason by Bed Factory Direct. This is reviewed on an individual case by case and will never exceed more than a 10% value of the order.

17. Statutory rights
These Terms & Conditions do not affect your statutory rights. 18. Governing law and jurisdiction These terms are governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the Courts of England and Wales.
